If there is no track number it is not possible to distinguish between
the two.

Distinguishing between the two and surfacing that distinction in an
application or even at the API level is not useful IMHO.

Hi just want to double check, that if there is no track number present 
it is not possible to differentiate between ID3v1 and ID3v11. To put it 
another way if a user requested that a  tag should be saved as ID3v11 
and thy have not supplied a track number a subsequent read should return

the track as ID3v10 ?
